My Story A Rotted Lap Ban 2003 - 2023

Hello, wish I had seen a forum like this 20 years ago. This is my experience with a lap ban rotting.

My weight in 2003 was 275, my family read about lap bands and encouraged me to get one. I had not been this overweight before, I was always thin but of course I didn't eat much so I stayed thin and was very physically active. As I got to 50 years old and had a hysterectomy 10 years previous, I gained 5+ pounds a year, I could not keep it off. So, I said OK, in 2003 I had it done. Upon getting it done, I threw up a lot, acquired a hiatal hernia, could not swallow saliva, it was so thick it would not go down, so I was contently throwing it up. I lost a lot of weight back to what I should have been within 9 months but continued to throw up the thick saliva getting me to thin. I found a few things I could eat, soup of course. By 2005 I began having pain in my side, I had liquid taken out of the ban so I could eat better and maybe not throw up so much. But I continued to have a weird pain. I asked my primary doctor if it could be the band and he said no. He did blood tests and it showed I have an infection, but he didn’t know what it would be. He gave me Flagle and of course that made me even sicker but within 2 weeks I felt a little better for about 2-3 weeks then it started again. This continued year after year, antibiotics 3-4 times a year, my doctor, never had me get the ban checked, didn’t even ask for a sonogram/ultrasound or CT, nothing. I just started having more and more pain until Sept 2011, gaining weight back, needing to drink a gallon of milk at a time, it seemed to cool my stomach or something. But I was getting weaker. I went to Italy regardless how I was feeling with friends and couldn’t even stand in line to go see a museum. Walking became very labored. By 2012, for most of the year, I was in bed, thinking it was a colon problem, I scheduled a doctor visit with a colon surgeon. He took one look at my stomach, pressed on it and I screamed. He said go to ER now! I barely got to ER, they gave me a contrast to drink, and I started shaking and passed out, I went septic and died, they brought me back to life. They found my lap ban had rotted and there was a abscess size of 3 apples ate a hole in my stomach. I woke up 4 days later, in and out 3 pumps coming out of my stomach with 3 1-inch pieces of foam 11 inches long and 3-4 inches wide. They could not suture up the area, it had to slowly close on its own removing the gauze twice a day after the foam was removed. It took 3+ months for it to heal closed. As time went by, I kept having what seemed to be a poke when I walked or bent over sat in straight up chairs, it seemed I always had to be in a lounging position, or I would be in pain. I had a hernia, they fixed it but again a month later I had that strange poking pain. I figured, the hernia tore or something and didn’t work. Over the years, I had more endoscopes, CT’s sonograms/ultrasounds, x-rays, and they never saw anything that would cause this pain, again I just figured it was the hernia.

February 2023, I had a lot of pain for days, so went to doctor, she had me go to my gastroenterologist. I think it was moving or it’s infected again. July 2023, I had my 3rd endoscopy, GUESS WHAT, THE PHOTOS SHOW AT LEAST 2 INCHES OF LAP BAND, a couple sections of them maybe as many as 4 sections showing up in the sonograms/ultrasounds, not sure what they did, one of the two. Why didn’t the doctor who removed it measure to be sure he got it all out!!! 11 years later I was right, the doctor who removed the band 11 years earlier, left much of the band inside. Yes, I have pictures all alone the way. A new CT the other day didn’t show anything, probably because of the material it’s made of, but the endoscopy, sonogram/ultrasound did show this time, it had not preveously before. So now I don’t know what the surgeon is going to do yet, waiting again to schedule appointment. I have a lot of anxiety knowing what I went through years ago and pray I don’t go through that again. My weight went up to 300 so I started a diet called, McDougall, I’ve lost 25 pounds in 3 months. Yes, I have cheated a few times but over all this diet worked really fast and brought my blood pressure down, all blood tests are so much better. Before you consider doing anything check out this diet first. I have infused some vegan, vegetarian and Asian food ideas, for my taste.
 
Statue of Limitations I'm sure is over.

It was clear from the beginning that you have had repeated occurrences of problems stemming from the original cause over the course of 23 years. There's no guarantee more won't crop up tomorrow for another 23 years.

See a lawyer and let him/her sort it out. I'm not a lawyer but reading your story impressed upon me that you've had chronic-NOT ACUTE--problems for a long time with no assurance these problems will ever end. Acute means sudden and usually temporary. Chronic means forever. And these problems have led to other problems which led to other problems. You don't know what will happen next. I don't get the impression that you've had one specialist follow your problems for 23 years, which would be the best documentation.

And what makes you think there's a statute of limitations? Each event, in the case of a statute of limitations, starts the statute's clock from ZERO again. And I'm sure you've done enough research to know the multitude of problems arising from lap band surgery. It is virtually not even done any more. Why would a doctor do such a mutilating surgery when we have such great bypass options?

I'm not sure what your driving reasons are, but to me, an ongoing problem like that is something like being held as a prisoner of war. In any case, I'd find the best lawyer around and submit a detailed list with dates and symptoms and doctor visits/hospitalizations and let him/her figure it out.

I don't intend to be cruel or critical when I say, "you're not a doctor." I mean it as a wake-up call. Let someone who is trained in bodily functions and finding disease sort it out. I've known more than a few people--my personal friends--who've suffered too long because for some reason they didn't think consulting a doctor was something they deserved. Some of those people are dead.
 
Also, even though I think you should be hospitalized for a battery of tests and fixes, it's clear to me that you don't think for yourself, that you're guided by others, and that you have very little self esteem. Someone has done a number on you, probably since childhood.

Put your health in the hands of a medical professional and leave it there. If you live anywhere in the midwest, I'd send my case to the Mayo Clinic and let them untangle the knots. You are in real trouble.

And recommending a diet at the end of your post is absolutely ridiculous. STOP TRYING TO FIX YOURSELF. YOU NEED PROFESSIONAL HELP. You could die before you even finish reading this post.

I'm in southern CA and I think now something is getting done, since it's visual now. I'm just waiting to be approved by my insurance and scheduled. I just found this out last week, was referred to a bariatric doctor, now waiting for call back from his office to schedule. Yes, I realize I could go septic any moment and it is very traumatic what I went through 11 years ago and yes, I've suffered for many years from it. I once worked for a dentist, he trained me from when I was 16 years old after school, he trained me very well, how to read x-ray, just everything. When I went to work for another dentist, I saw him do many underhanded things. I told my old boss and he said who is going to believe you, him which teaches at USC or UCI I can't remember which or you who has not gone to college for Dentistry. I think that set in my head.

AND, yes, I have had multiple problems since this. I have not talked to my primary doctor yet since finding this out but I'm sure when I do in a few weeks, her jaw will be dropped because I've gone from one specialist to another over the years and yes, I documented everything, but I have not written the story down till now. I partially did here not knowing they don't do lap bands anymore and was looking for others who this might have happen to. Hoped it would enlighten people that were thinking about doing it. I expect they might cut some of my stomach out, I don't know but the area where the band is still stapled or lodged. They have seen the staple in the past endoscopes, I have CD copies of those, so I saw it too, it never dissolved. I would not know what lawyer to go to.
 
I don't know if your phone company still has yellow pages, but they are online as yellowpages.com or something like that. They're not so necessary since a websearch can accomplish something similar by searching Attorneys>Medical Malpractice or something similar.

Also, there's a national phone number that's attached to your local bar association, something like Attorney referral. They offer a free phone call 30 minutes long where you can be given one or more names of attorneys who specialize in medical malpractice.

Your story is absolutely horrifying and it's possible there's still jeopardy that could pop up when you least expect it. You really do need a lawyer. I believe yours is the worst experience I've ever read, although bariatric surgical malpractice is rare. This procedure is so refined, it's more painful to go for a root canal than bariatric surgery these days.

I called legal and unfortunately, statue of Limitations applies to original date, 2012.

I have conference date set to talk with barbaric doctor. Hoping it will be taken care of soon.

I like to think I'm not a litigious person but you should lawyer-up. I hope you have a different surgeon, someone who is thought of as the best person to deal with your host of problems in your abdomen. For all you've been through and are still here is an inspiration. I'm asking God to put the best medical team in your life. If you are able to, keep me posted.
 
Thank you KristiLyn for your prayers, I do need them for sure. I did speak to a lawyer and just as I thought, "Statue of Limitations" was 2012-2013. It's obviously not long enough, even though there is new discoveries. Medical malpractic is only good to file for 1 year. So I have a consult coming up with a baraitic doctor that I hope will be good since I am HMO, to remove all the particles. Then maybe I can get my life back.
 
If you are still having complications I don’t see how statute of limitations applies. I am not a dr or a lawyer but I would talk to more than one lawyer til I found one that can help you. In the same way you have had many dr to find the real cause of your health problems.
 
The person I talked to at the law office was very specific, very nice but very specific that to much time has gone by. Probably lawyers in favor for doctors lobbied for laws to be good for only 1 year, not infanet and not even if new discovery has happened. And yes, the doctor who did this is still in practice. I just have to deal with this as it is and pray, all will go well.
 
I definitely understand that you've done research, but I feel so positive no statute of limitations can be applied to your case, considering the number of injuries and lifelong effects, not to mention trauma, pain and suffering. I'm so stubborn, I wouldn't quit until I had a court date. I mean, these things cannot be decided outside a court room. No matter what is written, or where it's written, laws are made every day in cases where the law supposedly can't be applied. I'd insist a judge have the final say.

And just to be completely frank, I have been a member of a huge lawsuit against a medical device. I won, along with thousands of other patients, even though we had given informed consent. The company ended up bankrupt, but a whole bunch of patients died before that happened, not to mention permanent injuries of different types.

Bottom line: I don't quit until a lawyer or judge says I have to.
 
Hi Diane, I called the Bar Association as well, they agreed the "Statue if Limitation" is over.
Shocking! The lawsuit I was part of involved an installed medical device that was placed in 1970, and it took about 5 years for people to realize the injuries and death that could be attributed to it. A couple of years later I was informed that I had suffered permanent damage from it and yes, I'm being vague here on purpose. I was told the extent of the damage to my body, which was devastating. At the same time a whole bunch of lawyers all around the world were filing personal injury lawsuits and that rolled into a movement. By the time I got a settlement, almost 20 years had passed.

I'm guessing the statute has changed over a long period of time, based on different types of injury claims. Having this discussion sent me to my state's statute, and it is, as most are, three years. When my terminally ill brother was in the hospital several years ago, I did a lot of research on his behalf, and in most cases, three years was mentioned, although in his case, his injuries led to complications which led to other injuries that were considered separate, so it got really difficult to arrive at a statute and complete settlement amount.

I appreciate the opportunity to have this discussion. I'm thinking now this is a topic or aspect of bariatric surgery that should be revisited.

And TNT, I'm so sorry you've had to go through all this horror. I hope your legal reps can get you some justice.
 
Thank you Diane, I'm sorry you had to go through so much also. I would guess things changed in favor of all this experimental medicine. They are our piers and we just believe them, I guess that's why it's called a practice and they experiment on us, without us knowing the truth of it for the long run, because they don't even know. So finding a lawyer to pursue this is going to be like a needle in a haystack. Lawyers these days want slam dunks. And, I'm getting to old to travel and to old to mentally handle all the stress of fighting it. I just hope that others will be aware of long run long term health problems from this.
 
I had an oOB/gyn put 9 laparoscopic staples one inch above my bladder on my ureter. When I reported to dr something was wrong the dr ignored me. Two years later I am peeing brown urine. My right kidney had stones from being blocked. I did sue with a personal injury lawyer. The settlement covered current bills with some damages but not enough for lifetime problems. Clifford law offices in Chicago is a leading quality personal Injury lawyer.
 
Sorry to hear Roni, maybe the statute of limitations was longer at that time, I don't know. I had a bad experience also with my obgyn, now deceased but didn't know until a couple years ago he stapled my fallopain tube folded over when closing it up, so I've been in pain from that, I mentioned it but again, was told must be scar tissue. Nothing can be done about that either.
